Car purchased from trader but DVLA will not release the V5C without an Inspection Certificate as it has been involved in a collision. Am I entitled to claim my money back?
I have brought myself a used car. At the time of purchase I was told that it had not been involved in any accidents. However having requested a new V5C certificate I am informed that the car has been in an accident and that a VIC is required before a certificate will be released. If the car fails the VIC do I have grounds to go back to the trader who sold me the car?
Because you specifically asked whether the car had been in an accident and the dealer lied to you then your claim is for misrepresentation. Clearly the vehicle has been in an accident. You are entitled to a full refund provided the trader can be located.
In a addition you are entitled to claim under the Sale of Goods Act for mis-description. Make sure you keep the original advert to prove the seller was selling as a business.
These situations are however best avoided.
