Rented a car in Spain but now I have been charged €1,000+ because the car clutch burned out and the hirer alleges this was my fault...
I rented a car and signed the usual hire car contract in Spanish. My card company, Saga, now claims this gives the car company the right to charge anything due under the contract. My case is that I am not liable for a clutch which burns out after 7,000 kilometres which the car hire company claims was caused by my bad driving.
Often it is a while before the hire company takes the money, making it all the more difficult to get evidence to support your case. If indeed that ever would have been feasible.
The issuer the Saga Visa Card at the time was Liverpool Victoria. Unfortunately you signed a contract that said that the car was fine and you would be liable to pay for any damage whether caused through driver error such, presumably, as hitting something or bad luck such as a stone cracking a windscreen. The contract said you could be charged up to 180 days after you returned the car.
The car hire company still maintains that you had driven badly and that the onus remained on you to prove that the car you were provided with was not fit for purpose but as a gesture of goodwill Liverpool Victoria have agreed via Saga to pay £500 as compromise towards your €1,033 bill.
